By accessing and using Tenant Screener, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

Description of Service

Tenant Screener provides a platform for landlords and property managers to create custom application links and collect tenant application information. The service facilitates the tenant screening process but does not make rental decisions or provide legal advice.

User Accounts

To use our service, you must:

• Create an account with accurate information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Not create multiple accounts to circumvent limits
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

Acceptable Use

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Discriminate against prospective tenants based on protected characteristics
• Collect or store tenant information for purposes other than tenant screening
• Share application links or data with unauthorized third parties
• Attempt to gain unauthorized access to our systems

Data and Privacy

Your use of the service is also governed by our Privacy Policy. As a landlord using our service:

• You are responsible for complying with all applicable data protection laws
• You must have a lawful basis for processing tenant information
• You agree to handle tenant data securely and confidentially
• You will not use tenant data for marketing or unrelated purposes

Intellectual Property

The service, including all content, features, and functionality, is owned by Tenant Screener and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our software or content
• Reverse engineer or attempt to extract source code
• Remove any copyright or proprietary notices
• Use our trademarks without permission

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The service is provided "as is" without warranties of any kind
• We are not responsible for rental decisions made using our service
• We do not verify the accuracy of information submitted by tenants
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months

Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• We discontinue the service

Upon termination, your right to use the service will immediately cease, and your data will be deleted in accordance with our Privacy Policy.

Indemnification

You agree to indemnify and hold harmless Tenant Screener from any claims, losses, damages, or expenses arising from your use of the service, violation of these terms, or violation of any rights of another party.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
